By using the website, creating an account, placing a purchase order, or any other use, you agree to be bound by this Agreement. If you do not agree, please do not use the website or services.

3. Scope of Services

The Company provides an online shopping platform that allows customers to browse, order, pay for, and receive delivery of products within the Kingdom of Saudi Arabia. The Company operates retail stores across all regions of Saudi Arabia, and their locations can be found on the website. The Company reserves the right to set quantity limits per order by account, payment method, or shipping address, with prior notice to the customer.

4. Account Registration and Security

4.1 Eligibility Requirements

Use of the website is limited to individuals who are eighteen (18) years of age or older and have the legal capacity to enter into binding contracts under Saudi Arabian regulations. Minors are not permitted to use this website or its services.

4.2 Registration Requirements

To purchase products, customers must create an account by providing accurate and up-to-date information including:

  • First and last name

  • Email address

  • Phone number

  • Username / ID

  • Password

The customer bears sole responsibility for the accuracy of all information provided. Providing false or misleading information constitutes a violation of these Terms and of Saudi Arabian regulations.

4.3 Account Security Obligations

  • You must maintain the confidentiality of your account credentials and are responsible for all activities conducted through your account.

  • You must immediately notify the Company at [email protected] if you suspect any unauthorized access.

  • The Company implements technical and administrative measures to protect account security in accordance with the PDPL and guidelines of the National Cybersecurity Authority.

5. Pricing, Payment, and Installment Options

5.1 Pricing

  • All prices are displayed in Saudi Riyals (SAR).

  • Prices include Value Added Tax (VAT) at the applicable rate (currently 15%) unless otherwise stated.

  • Delivery charges, if applicable, are displayed separately during the checkout process.

  • The Company is obligated under the E-Commerce Law to display accurate prices inclusive of all applicable taxes and fees.

5.2 Pre-Shipment Invoice

In accordance with the E-Commerce Law and VAT regulations, the Company issues a pre-shipment invoice in Arabic (with an English version for reference) upon payment confirmation. The invoice includes: product description, unit price, applicable VAT, additional charges, and total price.

5.3 Accepted Payment Methods

The Company accepts the following payment methods licensed by the Saudi Central Bank (SAMA):

  • Mada cards

  • Credit cards (Visa, Mastercard, American Express)

  • Apple Pay

  • Google Pay

  • Buy Now Pay Later (BNPL): Tamara and Tabby (subject to their respective terms)

  • Loyalty points redemption: Mukafaa and Qitaf programs

All payment service providers engaged by the Company are licensed by the Saudi Central Bank (SAMA).

5.4 Payment Security

The Company does not store credit or debit card data on its servers. All payment transactions are encrypted and processed through SAMA-licensed payment gateways. The Company is fully PCI-DSS compliant.

5.5 VAT Adjustments

In the event of changes to VAT rates after an order is placed but before full payment is received, the Company may adjust the applicable rate accordingly. Orders for which payment has been received in full will not be affected.

5.6 Installment Plans

Installment options are available through participating banks and Buy Now Pay Later service providers. Plans, fees, and eligibility criteria are presented during the checkout process. The Company is not a party to the financing terms between the customer and the bank or service provider and bears no responsibility thereof. Refunds for installment orders are subject to the policies of the relevant bank or service provider.

6. Product Information, Inventory, and Sales Contract

6.1 Product Information Obligations

In compliance with the E-Commerce Law, the Company provides for each product listed on the website:

  • Product name, description, and images

  • Price inclusive of VAT

  • Stock availability status

  • Estimated delivery timeframe

  • Warranty information

  • Any applicable restrictions or conditions

Electronic advertisements published on the website are contractual in nature under the E-Commerce Law and are legally binding. Product listings are accurate to the best of the Company's knowledge; typographical or display errors may occur and will be corrected upon discovery.

6.2 Stock Availability

Inventory levels and prices are subject to change without prior notice. In the event of a pricing error or stock depletion after an order is placed, the Company will contact the customer within 24 hours to offer an alternative, correct the price, or provide a full refund.

6.3 Formation of the Sales Contract

The sales contract is concluded in accordance with the E-Commerce Law as follows:

  • Step 1: The customer submits the order and authorizes payment.

  • Step 2: The Company sends an order receipt email (this does not constitute acceptance of the order).

  • Step 3: The Company sends an order confirmation email including the estimated delivery date — at this point the sales contract is concluded.

All sales contracts are concluded electronically and have full legal effect under Saudi Arabia's Electronic Transactions Law.

7. Shipping, Delivery, and Returns

7.1 Shipping Policy

  • The Company ships exclusively within the Kingdom of Saudi Arabia; no international shipments are made.

  • Delivery time ranges from 3 to 15 business days, excluding Fridays and official public holidays (Eid Al-Fitr, Eid Al-Adha, National Day, etc.).

  • Upon shipment, the customer receives an email containing a post-shipment invoice with: reference number, product quantity, unit price, VAT, total price, serial number (if available), tracking number, and shipping company details.

  • Delivery is completed upon handing over the product to the address specified by the customer.

  • After three failed delivery attempts with no one present, the Company reserves the right to cancel the order. The cancellation policy applies.

  • The shipment must not be accepted if the security seal is broken or the package shows signs of tampering. Accepting the shipment confirms that the package is in good condition.

7.2 Returns and Exchanges

In accordance with Article 15 of the E-Commerce Law:

Legal Right

Customers are entitled under Saudi E-Commerce Law to return a product within 3 calendar days and exchange it within 7 days of receipt, provided it has not been used or benefited from.

Details of the Company's returns and exchange policy:

  • Returns: must be initiated within 3 days of receipt for standard products.

  • Exchanges: must be initiated within 7 days of receipt.

  • Products must be returned in their original unused condition with full packaging, accessories, warranty card, and invoice.

  • For watches: "unused" means not worn outside the initial try-on location; no scratches, marks, or modifications; and the bracelet size has not been adjusted.

The Company bears the cost of return shipping in the following cases (as required by law):

  • The product is defective or damaged upon receipt.

  • The product is incorrectly described on the website.

  • The wrong product was delivered.

  • Delivery is delayed by more than 15 business days from the purchase date.

In all other cases, the customer bears return shipping costs.

7.3 Returns Procedure

  • Log in to your account on the website.

  • Go to Orders and select the product you wish to return or exchange.

  • Select the reason for the return/exchange and submit the request.

  • The Company will review and approve or reject the request within 3 business days.

  • Upon approval, a courier will be dispatched to collect the product according to the shipping company's schedule.

7.4 Right to Refuse Returns

The Company reserves the right to refuse a return if the product does not meet the conditions set out in Section 7.2. In such cases, the customer will be notified in writing and the product will be returned to them at their own expense.

8. Refunds

  • Upon approval of a return, the Company will begin processing the refund within 3 business days.

  • The amount will be refunded to the original payment method used, except for installment services or points.

  • Refund processing time depends on the payment method and issuing bank, and typically ranges from 5 to 15 business days.

  • Products purchased with loyalty points (Mukafaa/Qitaf) cannot be refunded as cash; they will be converted to store credit.

  • Refunds are not available for installment purchases, subject to the Buy Now Pay Later terms.

9. Defective Products and Warranty

9.1 Legal Rights

Nothing in this Agreement affects the customer's legal rights under Saudi consumer protection legislation with respect to defective, damaged, or non-conforming products.

9.2 Reporting Defective Products

If you receive a defective product:

  • Contact customer support immediately through the website or the Contact Us page, or at [email protected], within 3 days of receiving the product.

  • An inspection can be arranged at one of the Company's service centers (locations available on the website via the store locator).

  • The Company will arrange a return, repair, replacement, or refund as required by law.

9.3 Product Warranty

Products are subject to the original manufacturer's warranty. Warranty terms and duration vary by brand and product category. The warranty card included with the product is the official warranty document and must be retained. The warranty does not cover: damage resulting from misuse, negligence, modifications, unauthorized repairs, physical damage, or normal wear and tear.

10. Promotions and Daily Deals

  • Daily deals are valid for 24 hours or until stock runs out.

  • Products under a daily deal are delivered within 3 to 7 business days.

  • Promotions cannot be combined with other offers or discounts.

  • The Company reserves the right to withdraw any promotion at any time.

11. Loyalty Programs (Mukafaa and Qitaf)

11.1 Mukafaa Program

  • Log in to your account to earn Mukafaa points with every purchase.

  • Earn 10 Mukafaa points for every Saudi Riyal spent (up to a maximum of 50,000 points).

  • Points are credited within 21 days of confirmed delivery.

  • Points are not awarded on cancelled orders.

  • Products purchased with points cannot be refunded as cash; store credit or point transfer applies.

  • The full Mukafaa program terms apply in addition to these Terms.

11.2 Qitaf Program

  • Earn 10 Qitaf points for every SAR 1.5 spent.

  • Points are credited within 21 days of confirmed delivery.

  • The full Qitaf program terms apply in addition to these Terms.

12. Price Match Policy

  • Applies only to new products with the same brand, model, and retail package (warranty, original box, documentation).

  • For international retailers, the competitor price must include 15% VAT and 5% customs duty (total 20%) on top of the advertised price.

  • Price matching within Saudi stores is at the same value with no additional amounts.

  • Submit price match requests on the product page before purchase, including your name, phone number, email, competitor product link, and advertised price.

  • Upon approval, a payment link for the product at the matched price will be sent to your email.

13. Website Use, Maintenance, and Acceptable Conduct

13.1 Permitted Use

The website is intended for personal use only or on behalf of an entity that the customer legally represents. Commercial resale or unauthorized use is prohibited and may result in account termination and legal action.

13.2 Prohibited Conduct

Customers are prohibited from using the website to:

  • Infringe the intellectual property rights of any third party.

  • Transmit harmful, unlawful, threatening, abusive, defamatory, or obscene material.

  • Engage in fraudulent activities, deception, or identity impersonation.

  • Attempt unauthorized access to the Company's systems — a violation of the Cybercrime Law (Royal Decree M/17, 2007).

  • Transmit malware, viruses, or malicious code.

  • Collect or store other users' personal data without their consent.

  • Engage in spam, pyramid schemes, or unsolicited advertisements.

13.3 Maintenance

The Company strives to provide continuous access. Customers will be notified by email of scheduled maintenance. The Company is not responsible for downtime due to force majeure or third-party failures.

14. Intellectual Property Rights

All intellectual property rights related to the website and its content — including copyrights, trademarks, patents, logos, domain names, and technical expertise — belong exclusively to the Company and are protected under Saudi intellectual property laws and international treaties. Customers may not reproduce, modify, distribute, or commercially exploit any content without prior written approval.

15. Disclaimers, Warranties, and Limitation of Liability

  • The website and services are provided "as is". The Company does not guarantee uninterrupted, error-free, or virus-free operation.

  • The Company is liable only for losses that were foreseeable at the time of purchase and resulting from the Company's breach of this Agreement.

  • The Company is not liable for indirect, incidental, punitive, or consequential damages, to the extent permitted by Saudi law.

  • Products are intended for personal use only. The Company is not liable for commercial losses arising from misuse.

  • The Company's liability shall in no event exceed the amount paid by the customer for the product in question.

16. Indemnification

Customers agree to indemnify and hold harmless the Company, its affiliates, subsidiaries, officers, directors, agents, employees, and representatives from any claims, damages, or liabilities (including attorneys' fees) arising from: (a) use of the website in breach of these Terms; (b) any violation of applicable Saudi regulations; or (c) any unauthorized or improper use of the website.

17. Cancellation Policy

17.1 Customer Cancellation

The customer may cancel an order in the following cases:

  • Before the order has been shipped.

  • If delivery is delayed by more than 15 business days from the confirmed purchase date and the product has not been used — in this case, the sales contract is terminated and a full refund is issued.

Cancellation requests after shipment are treated as returns and are subject to the returns policy in Section 7.

17.2 Company Cancellation

The Company may cancel a customer's order due to:

  • Pricing errors on the website.

  • Product unavailability due to technical issues.

  • Payment rejection or failure to complete payment.

  • Incorrect delivery address or inaccurate contact details.

  • Customer's failure to receive the shipment after three attempts.

  • Any fraudulent or suspicious activity associated with the order.

If the Company cancels an order, it will issue a full refund. The Company may deduct reasonable expenses incurred due to the cancellation where permitted by law.

18. Termination of Contractual Relationship

The Company reserves the right to immediately terminate a customer's access to the website if they breach any provision of this Agreement. Termination does not affect any rights or remedies available under Saudi regulations.

19. Force Majeure

The Company shall not be liable for any delay or failure to fulfil its obligations if the failure is caused by circumstances beyond its control, including: carrier failures, communications outages, natural disasters, government actions, labor disputes, wars, cyberattacks, and other emergencies.

20. Dispute Resolution

In the event of any dispute arising under this Agreement or from the use of the website and services, the parties shall first seek to resolve it amicably within 30 days of written notice. If unresolved, customers may escalate the complaint to:

  • Consumer Protection Portal at the Ministry of Commerce and Investment (MoCI) at mc.gov.sa

  • Consumer Protection Association

  • Competent Saudi courts

This Agreement is governed by the laws of the Kingdom of Saudi Arabia. All disputes are subject to the exclusive jurisdiction of Saudi Arabian courts.

21. General Provisions

Non-Waiver

The Company's failure to enforce any provision shall not constitute a waiver of its rights.

Severability

If any provision is found invalid or unenforceable by a competent court, that provision shall be excluded and the remaining provisions shall continue in full force and effect.

Entire Agreement

This Agreement, together with all referenced policies, constitutes the entire agreement between the Company and the customer.

Assignment

Customers may not assign their rights or obligations under this Agreement without prior written consent. The Company may assign this Agreement at its discretion.

Language

This Agreement is drafted in both English and Arabic. In the event of any conflict or ambiguity, the Arabic version shall prevail in accordance with Saudi law.

Updates

These Terms may be updated with 5 days' notice via the website and email. Continued use after the effective date constitutes acceptance. Customers who do not agree must notify the Company at [email protected] within 5 days, after which their account may be suspended.

When personal data is no longer needed, we securely delete or anonymize it in accordance with PDPL requirements.

  • The customer's explicit consent has been obtained for the specific transfer.

All international transfers comply with the regulations governing the transfer of personal data outside the Kingdom.

11. Anti-Phishing Notice

The Company will never ask for your password, card details, or any sensitive personal information via unsolicited emails, text messages, or phone calls. If you receive a suspicious communication claiming to be from Al-Hussaini Trading Company, please report it immediately at [email protected].

12. Changes to the Privacy Policy

This policy is an integral part of the Terms and Conditions and applies to all purchases made through www.alhussainitrading.com. This policy is compliant with Article 15 of the Saudi E-Commerce Law.

1. Order Cancellation

1.1 Customer Cancellation

You may cancel your order in the following cases:

  • Before the order has been shipped.

  • If delivery is delayed by more than 15 business days from the confirmed purchase date and the product has not been used.

1.2 Company Cancellation
